Training terms and conditions

ONE TO ONE PERSONAL TRAINING

In choosing Sound Fitness Studios you have already shown that you possess the personal resolve and capability to make the positive changes in your life to achieve your fitness and nutrition goals. With our help, you will be able to accelerate your results through working hard and having fun whilst getting the assistance you need to achieve your goals.

Personal Training membership is not transferable or assignable. Training sessions must have begun within 30 days of the date of purchase unless otherwise agreed. It understood the current policies and the terms it presents are for the purchase of sessions and any other purchase of services in the future.

TRAINERS RESPONSIBILITY

  1. To support you to achieve results in your health and fitness goals.

  2. Ensure all exchanges remain confidential.

  3. To be accepting and understanding of your progress, your experiences and setbacks no matter what and help you rise above all that stands in the way of you achieving your goals.

  4. Offer clear weekly targets and ideas to help you stay focused and motivated along the journey.

CLIENT RESPONSIBILITY

Your role is taking full responsibility for your own results. Whilst we will do everything, we can to support your progress, ultimately you must accept full responsibility and be ultimately accountable for all steps along the way.

ONE TO ONE PERSONAL TRAINING POLICY

You must wear appropriate gym attire (i.e. shorts, sweatpants, t-shirt, tennis/running shoes, etc.) If you are not wearing suitable attire the trainer reserves the right to refuse participation in the session and no refund will be granted.

All FOREST HILL Training sessions will be conducted at Sound Fitness Studios and last a maximum of 30 ,45 or 60 minutes. All training sessions content details will be recorded on a secure cloud-based server online and progress logged by Sound Fitness.

Personal training sessions must be conducted as one-to-one (one trainer, one client) unless otherwise agreed upon All training sessions exercise details and progress will be recorded on a secure cloud-based server online and progress logged by Sound Fitness you can request to view these records at any time. 

SOUND FITNESS CANCELLATION AND LATENESS POLICY 

The cancellation and lateness policy detailed below is applicable to all clients All appointment times are reserved cancellations must be made a minimum of 24 hours in advance prior to the start of the scheduled training session time. No refund for missed appointments is available. It is the client’s responsibility to attend personal training appointments when they are scheduled. Every effort will be made to reschedule a training session according to the mutual availability of the client and trainer If a cancellation is not made by a minimum of 24 hours prior to the scheduled session, the full cost of the session will be charged for the session. Likewise, a ‘no show’ counts as a session serviced and will be charged or subtracted from the outstanding sessions due that month or from the purchased block.

PAYMENT POLICY

FOREST HILL PURCHASED PT BLOCK SESSIONS POLICY

Payment is due a minimum 24 hours before the first session commences. All training sessions must be paid in full directly to Sound Fitness Studios prior to any participation in any training sessions.

Personal Training sessions must have begun within 30 days of the date of purchase unless otherwise agreed. and must be used within Specified days from purchase detailed below unless they form part of a special package or program that sound fitness should introduce from time to time that extends beyond 98 days.

Blocks of 4 to be completed within 42 days of purchase

Blocks of 8 to be completed within 70 days of purchase

Blocks of 12 to be completed within 98 days of purchase

Clients that have signed up for a specific weekly duration package such as the “12-week body transformation” all sessions applicable to the tier selected must be completed within the specified period. Sessions not completed will be considered void at the end of the 12-week period.

4 weekly subscription packages are a 12 week mimimum commitment to regular training and payments.

CONTINUOUS PAYMENT AUTHORITY

We will debit from your chosen debit or credit card provided your membership Fee on a 4 weekly or monthly basis automatically depending on the package you have chosen. The subscription price will NOT be increased without prior notification in writing.

The payment for one to one personal training fee amount is due from you to us. you are obligated to make the minimum number of automatic payments agreed as part of your membership or subsription package usually a 12 week commitment unless otherwise agreed with the first payment debited on the day of sign up to membership and every 4 weeks thereafter You are obligated to make every continuous authority payment regardless of non-attendance, except where the cancellation terms below are met 

CANCELATION AND MEMBERSHIP FREEZE

  1. This agreement can be cancelled if your new permanent address is more than 5 miles away from the facility upon receipt of a copy utility bill or bank statement showing the new address.

  2. Long term (over 3 months) illness or injury: This agreement may be cancelled in the event of an illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for 3 months or longer upon appropriate proof being provided.

  3. This agreement can be cancelled upon appropriate proof of redundancy from your employer or other loss of livelihood.

  4. This agreement can be cancelled if we are in breach of contract including if we do not provide facilities or services you may reasonably expect, and we have fallen well below that standard.

  5. This agreement may be frozen in the event of a temporary illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for a period of time. Please note – any Freeze will not be effected until the appropriate proof is provided and received (in writing or via email) by Sound Fitness Studios ltd – A freeze period does not affect the Minimum Number of continuous Payment authority you are due to make and any payments remaining at the time of the freeze will remain due and recommence on a 4 weekly basis once the freeze period has completed.

RENEWAL POLICY

Once you have completed the minimum number of continuous authority payments, we will automatically continue collecting the Payment Amount every 4 weeks And your membership will be extended by one month for each payment (“Renewal Period”). This renewal of the continuous payment amount may only be amended if we advise you in writing giving not less than 30-days-notice of change and the opportunity to cancel You may stop the Automatic Renewal at any time by giving cancellation notice to our email address info@soundfitnessstudios.com (you should give us not less than 21 days-notice). 

SOUND FITNESS ONLINE TRAINING AGREEMENT 

The online stream service when made available will offer regular live and pre-recorded sessions and any changes to the timetable will be advised no less than 7 days in advance. 

Live sessions will be conducted via Zoom or a similar stream service and you will be provided with login details for all sessions .no admittance will be permitted once the live stream has begun and it is advised to join the stream at least 5 mins prior to the session start. 

Sound fitness may offer additional services such as recipe books and individual meal plans. Meal plans will be provided based on the data provided by you and we cannot accept responsibility for inaccurate measurements leading to an incorrect calorie counted meal plan being provided. 

PAYMENT 

The monthly online service is paid by a recurring continuous payment authority starting on the date at which you sign up. 

The 8 or 12 -week package including equipment such as resistance bands may require full payment in advance if the promotion advertises this to be the case At the end of the 3-month period, your payment will revert to the regular monthly stream membership cost of the monthly stream, membership requires 21 days’ notice via email to info@soundfitnessstudios.com 

MONTHLY ONLINE MEMBERSHIP CANCELLATION POLICY 

8 or 12-week package cancellation policy 

You can cancel the membership program within 14 days of signing up if you change your mind or the program no longer fulfils your requirements. you will be refunded the cost of the package minus the cost of the equipment provided and any postage costs incurred 

WAIVER OF LIABILITY 

I have enrolled in a program of strenuous physical activity supervised by Sound Fitness Studios. I hereby affirm that I am in good physical condition and do not suffer from any disability that would prevent or limit my participation in this program. I fully understand that 

I may suffer injury as a result of my participation in the program and I hereby release Sound Fitness any and all liability now or in the future, including but not limited to medical expenses, lost wages, pain and suffering, that may occur by reason of heart attacks, muscle strains, pulls or tears, broken bones, shin splints, heat prostration, knee/lower back/foot injuries, and any other illness, soreness, or injury, however caused, whether occurring during or after my participation in the program or use of the conditioning and exercise equipment and facilities, regardless of fault. 

I understand that Sound fitness studios ltd shall not be liable for any damages arising from personal injuries sustained by myself during the online training sessions or from a personal training program and partake at my own risk. I assume full responsibilities for any injuries or damages which may occur during and after training. 

VIDEO AND PHOTOGRAPHY POLICY

You consent to Sound Fitness Studios using photographs and/or video recordings including images of me both internally and externally to promote the business. These images could be used in print and digital media formats including print publications, websites, e-marketing, posters banners, advertising, film, and social media 

I understand Sound Fitness will advise in advance where possible should video shoot or photography session be planned for a session that I am scheduled to attend and that I may request for professional or personal reasons my face be obscured from any images that are used as described above. I can also advise in writing to info@soundfitnessstudios.com my request not to be included in images or video footage and that sound fitness will to the best of their ability to honour this request.

I understand that images on websites can be viewed throughout the world and not just in the United Kingdom and that some overseas countries may not provide the same level of protection to the rights of individuals as EU/UK legislation provides. I understand that some images or recordings may be kept permanently once they are published and be kept as an archive of Sound Fitness history.

TERMINATION 

Sound Fitness has the right and the authority to terminate the agreement at any time, with no refund, if a client does not follow the program with specific requirements and where a commitment to a specific number of weeks or sessions is required 

We may terminate this agreement with immediate effect on notice to you if you are in breach of the Client agreement (i.e. Stealing or other criminal activities within the facility). In this event, you will not be liable to pay any further automatic continuous Payments, provided such breach is not deemed by us to have occurred primarily in order to qualify you for a refund. 

We will do our best to resolve any disputes over this agreement. If you wish to take court proceedings against us you must do so within the United Kingdom. Relevant UK law will apply.
